OFFICIAL RULES
NO PURCHASE NECESSARY, PURCHASES DO NOT INCREASE YOUR CHANCES OF WINNING. ODDS OF WINNING DEPEND ON NUMBER OF ENTRIES RECEIVED.
1. Eligibility: The Specialty Retailers, Inc. TEEN FASHION BOARD Promotion (the “Promotion”) is open only to legal residents of the fifty (50) United States (including District of Columbia) who are at least 14 years of age and no more than 18 years of age at the time of entry, have their parents permission, and are members of the TEEN FASHION BOARD ("Members").
Employees of Specialty Retailers, Inc., Stage, Bealls, Palais Royal and Peebles, and their parent and affiliate companies, suppliers as well as the immediate family (spouse, parents, siblings and children) and household members of each such employee are not eligible.
Participation constitutes entrant’s full and unconditional agreement to these Official Rules and Sponsor's and Administrator’s decisions, which are final and binding in all matters related to the Promotion. Winning a prize is contingent upon fulfilling all requirements set forth herein. Subject to all applicable federal, state and local laws and regulations. Void where prohibited.
2. Sponsor and Administrator: Sponsor is Specialty Retailers, Inc. 10201 Main Street Houston, TX 77025. Administrator is Oak Interactive, LLC, 22136 Westheimer Pkwy, Suite 620, Katy, TX 77450.
3. How to Enter: Entry is limited to eligible Members of the TEEN FASHION BOARD only. NO PURCHASE NECESSARY, PURCHASES DO NOT INCREASE YOUR CHANCES OF WINNING. Each month the Sponsor or Administrator will notify the Members of the TEEN FASHION BOARD via email of a new opportunity to participate in a forum on teen fashion ("Forum") The Forums will be in either an online chat or survey format, and will be hosted at www.fashionrulz.com. Every Member who logs on the website to chat, or completes an online survey ("Participates") while the Forum is open will automatically be entered to win that month's First Prize, and will also be automatically entered to win the Grand Prize.
Members who Participate or attempt to Participate after the close of any Forum will not receive an automatic entry to win either a First Prize or the Grand Prize and are ineligible to win the First Prize for that month. Multiple persons are not permitted to share the same email address. Any attempt by any person to obtain more than one entry by using multiple different email addresses, identities, registrations, logins, or any other methods will void that person's entries and that entrant may be disqualified. Similarly, the use of any automated system to participate is prohibited and will result in disqualification. In the event of a dispute as to any entry, the authorized account holder of the email address will be deemed to be the registrant or Member. The “authorized account holder” is the natural person assigned an email address by an Internet access provider, online service provider or other organization responsible for assigning email addresses for the domain associated with the submitted address. Potential winners may be required to show proof of being the authorized account holder.
4. Timing: The Promotion begins on September 15, 2008 at 12:00 a.m. Eastern Time ("ET") and ends on July 31, 2009 at 11:59 p.m. ET (the "Promotion Period"). Sponsor is the official time keeper for this Promotion. First prize drawings will be held within seven (7) days after the close of the survey or chat for that month. Surveys are scheduled on or about 10/27/08 – 10/31/08, 12/1/08 – 12/5/08, 2/2/09 – 2/6/09, 3/30/09 – 4/3/09, 6/1/09 – 6/5/09 starting at 12:01a.m. ET the first day of each survey and closing at 12:00 p.m. ET the final day of each survey. Chat forums are scheduled on or about 11/19/08, 1/7/09, 3/11/09, 5/13/09, and 7/15/09. Forums will begin at approximately 8:00 p.m. ET and will be open for approximately 1 hour but may exceed the time allotted due to number of forum participants. Forums Sponsor reserves the right to make changes to the schedule for surveys and chat forums.
5. Winner Determination: Sponsor will randomly select the potential monthly First Prize winners from all Members who Participate in the Forum for that month. On or about July 31, 2009, Sponsor will randomly select the Grand Prize winner, from among all Members who Participated in any Forum during the Promotion Period.
6. Verification: All potential winners are subject to verification by Sponsor. An entrant is not a winner of any prize, even if notified of being a winner unless and until the entrant's eligibility has been verified. Potential winners must continue to comply with all terms and conditions of these Official Rules, and winning is contingent upon fulfilling all requirements. The potential Promotion winners will be notified by email or phone, and posting on the TEEN FASHION BOARD website after the date of their respective random drawing selection. Within fifteen (15) calendar days of the attempt to notify the potential Grand and First Prize winners, he or she, and their parent or legal guardian if they are a minor in his/her state of residence, will each be required to sign and return to Sponsor an Affidavit of Eligibility, Liability & Publicity Release to claim his/her prize. If a potential winner of any prize cannot be contacted, fails to sign and return the Affidavit of Eligibility, Liability and Publicity Release within the required time period (if applicable), or prize is returned as undeliverable, potential winner forfeits prize. In the event that a potential Grand or First, Prize winner is disqualified for any reason, Sponsor will award the applicable prize to an alternate winner by random drawing from among all remaining online entries. There will be three (3) alternate drawings after which the applicable prize will remain unawarded.
7. Prizes: ONE (1) GRAND PRIZE: Trip for three (3) days and two (2) nights for one (1) Member and their parent or legal guardian to Houston Texas to be a "Buyer for a Day." Trip package includes roundtrip air transportation for two (2) from a major airport near winner's home (determined by Sponsor in its sole discretion) to Houston, TX and two (2) nights hotel accommodations (terms and conditions apply). Total retail value of Grand Prize estimated to be $1600. Actual value may vary based on price of flight at the time of booking and distance between departure city and Houston. Winner must travel within one (1) year from the drawing date or prize will be forfeited in its entirety. Trip must be booked at least twenty-one (21) days prior to departure. Trip subject to availability and blackout dates. Travel must be roundtrip. Sponsor will determine air transportation provider and flight itinerary in its sole discretion. No refund or compensation will be made in the event of the cancellation or delay of any flight. Travel is subject to the terms and conditions set forth in these Official Rules, and those set forth by the air transportation provider. All expenses and incidental travel costs not expressly stated in the package description above, including but not limited to, meals, incidentals, passenger tariffs or duties, surcharges, airport fees, service charges or facility charges, personal charges at lodging, security fees, taxes or other expenses are the sole responsibility of the winner. If winner is a minor in his/her state of residence, at least one (1) of his/her travel companions must be winner’s parent or legal guardian, and must travel on same itinerary and at the same time. Travel companion must execute liability and publicity releases prior to issuance of travel documents. If in the judgment of Sponsor air travel is not required due to winner’s proximity to prize location, ground transportation will be substituted for roundtrip air travel at Sponsor’s sole discretion. Sponsor will not replace any mutilated, lost, or stolen tickets, travel vouchers or certificates and Winner will not receive the difference between approximate and actual retail value.
TEN (10) FIRST PRIZES: Six (6) junior sportswear wardrobes (retail value $200); one (1) Apple® iPod Nano® 8GB MP3 Player with earphones, USB cable, dock adapter, quick start guide (retail value $199.99); one (1) Apple® iPod Shuffle® 1GB MP3 Player with earphones, dock and quick start guide (retail value $49.99); one (1) Apple® iPod Touch® 8GB MP3 Player with earphones, USB 2.0 cable, dock adapter, polishing cloth, stand and quick start guide (retail value $299.99); and one (1)Apple® iPhone® 3G with 8GB Memory (retail value $199.99). Apple® iPhone® prize does not include service agreement with any wireless carrier. Items comprising junior sportswear wardrobe will be from a clothing manufacturer of Sponsor's choice, to be determined by Sponsor at the time of the drawing at its sole discretion, no substitutions allowed.
Odds of winning a Prize depends on number of entries received during the Promotion Period. Limit: One (1) Prize per person.
For All Prizes: No cash equivalent or store credit will be given or provided or available as a substitution for any prize. All prizes are non-transferable. Sponsor reserves the right to substitute any listed prize for one of equal or greater value if the designated prize should become unavailable for any reason. Winner is responsible for all taxes and fees associated with prize receipt and/or use. Winner will be required to complete an IRS W-9 for any prize valued over $600. TOTAL ARV OF ALL PRIZES: $3,600.00.
8. Release: By entering this Promotion or winning a prize, winner agrees to release and hold harmless Sponsor, Administrator, and their respective subsidiaries, affiliates, vendors, advertising or promotion agencies, distributors, and each of their respective parent companies and each such company’s officers, directors, employees and agents (collectively, the “Released Parties”) from and against any claim or cause of action, including, but not limited to, personal injury, death, or damage to or loss of property, arising out of participation in the Promotion or receipt or use or misuse of any prize.
9. Publicity: Except where prohibited, participation in the Promotion constitutes winners consent to Sponsor’s use of winner’s name, likeness, photograph, voice, opinions and/or hometown and state for promotional purposes in any media, worldwide, without further payment or consideration.
10. General Conditions: Sponsor reserves the right to cancel, suspend and/or modify the Promotion, or any part of it, if any fraud, technical failure or other factor beyond Sponsor’s reasonable control impairs Sponsor's ability to properly conduct the Promotion, as determined by Sponsor in its sole discretion. In such event, Sponsor reserves the right to award the prizes at random from among the eligible entries received up to the time of the factor. Sponsor reserves the right in its sole discretion to disqualify any individual it finds to be in violation of these Official Rules. Any attempt to undermine the operation of the Promotion may be a violation of criminal and civil law, and, should such an attempt be made, Sponsor reserves the right to seek damages from any such person to the fullest extent permitted by law. Sponsor’s failure to enforce any term of these Official Rules shall not constitute a waiver of that provision.
11. Limitations of Liability: The Released Parties are not responsible for: (1) technical failures of any kind, (2) any incorrect or inaccurate information, whether caused by entrants, printing or computing errors or by any of the equipment or programming associated with or utilized in the Promotion; (3) unauthorized human intervention in any part of the entry process or the Promotion; (4) technical or human error which may occur in the administration of the Promotion or the processing of entries; or (5) any injury or damage to persons or property which may be caused, directly or indirectly, in whole or in part, from entrant’s participation in the Promotion or receipt or use or misuse of any prize. If for any reason an entrant's entry is confirmed to have been erroneously deleted, lost, or otherwise destroyed or corrupted, entrant’s sole remedy is another entry in the Promotion, provided that if it is not possible to award another entry due to discontinuance of the Promotion, or any part of it, for any reason, Sponsor, at its discretion, may elect to hold a random drawing from among all eligible entries received up to the date of discontinuance for any or all of the prizes offered herein. No more than the stated number of prizes will be awarded. In the event that technical or any other reasons cause more than the stated number of prizes as set forth in these Official Rules to be available and/or claimed, Sponsor reserves the right to award only the stated number of prizes by a random drawing among all legitimate, unawarded, eligible prize claims.
12. Disputes: Except where prohibited, entrant agrees that: (1) any and all disputes, claims and causes of action arising out of or connected with this Promotion or any prize awarded shall be resolved individually, without resort to any form of class action, and exclusively by the appropriate federal or Texas State Court located in Harris County, Texas; (2) any and all claims, judgments and awards shall be limited to actual out-of-pocket costs incurred, but in no event attorneys’ fees. All issues and questions concerning the construction, validity, interpretation and enforceability of these Official Rules, or the rights and obligations of the entrant and Sponsor in connection with the Promotion, shall be governed by, and construed in accordance with, the laws of the State of Texas, without giving effect to any choice of law or conflict of law rules (whether of the State of Texas or any other jurisdiction), which would cause the application of the laws of any jurisdiction other than the State of Texas.
13. Entrant's Personal Information: Information collected from entrants is subject to Sponsor's privacy policy which can be found at www.fashionrulz.com.
14. Winner List: Winners will be posted on www.fashionrulz.com through August 30, 2009.
